Following is a summary of the status of House Bills of interest to the fire service:

House Bill 07-1008, Concerning Workers' Compensation Coverage for Firefighters Who Contract Certain Types of Cancer.

 

Bill Summary:  Requires that, under the "Workers' Compensation Act of Colorado", if a firefighter contracts cancer of the brain, skin, digestive system, hematological system, or genitourinary system, the condition or impairment shall be deemed to have occurred within the course and scope of employment unless a physical examination of such firefighter shows evidence of such condition or impairment that preexisted employment.

HB07-1031, Concerning Length of Service Awards for Bona Fide Volunteers Who Provide Qualified Emergency Services.

 

HB 1031 is state enabling legislation, allowing fire departments and other emergency services agencies to set up a “length of service award program,” which is already allowable under the U. S. Internal Revenue Code, Section 457(e)(11). This bill was necessary to conform state statutes to IRS requirements, so that there are not conflicts and unintended consequences.

HB07-1092, Concerning the Authority of County Governments to Regulate Fireworks.

 

HB 1092, as enacted permits a county to prohibit or restrict the sale, use, and possession of fireworks, including permissible fireworks, within all or part of the unincorporated areas of the county.  However, it includes an exception that any such ordinance shall not be in effect between May 31 and July 5 of any year unless the ordinance includes an express finding, based on competent evidence, that the danger of forest or grass fires is high in the areas of the county in which the ordinance applies.

HB07-1117, Concerning The Requirement That A Protective Helmet Be Worn By A Person Under Eighteen Years Of Age During The Operation Of Certain Vehicles.

 

Bill Summary:  Requires a person under 18 years of age who is an operator of a motorcycle or motorized bicycle and a person under 18 years of age who is a passenger on a motorcycle or motorized bicycle to wear a protective helmet that is designed according to certain specifications.

House Bill 07-1153, Concerning a Tax Rebate for Volunteer Firefighters.

 

Bill Summary: For the 2007-08 and 2008-09 fiscal years, allows a qualified volunteer firefighter to apply for a tax rebate through the department of revenue for a specified amount for 2 consecutive years.

HB07-1159, Concerning the Manner in Which a Special District Conducts a Ballot Issue Election.

 

Requires all special district ballot issue elections to be conducted either as part of a coordinated election or in accordance with the provisions of the "Mail Ballot Election Act".

HB07-1199, Concerning "Uniform Emergency the Enactment of the Volunteer Health Practitioners Act".

 

Bill Summary:  Enacts the "Uniform Emergency Volunteer Health Practitioners Act", drafted by the national conference of commissioners on uniform state laws. Allows a health care practitioner who is licensed in another state to volunteer to provide assistance in this state for the duration of an emergency requiring substantial health care assistance if such other state has a registry listing for the volunteer that conforms to certain standards.
